A case brought against a couple who allegedly defrauded a consultant of $433,400 under the pretext of selling to him two apartments at Airport Residential Area but failed, has been withdrawn and quashed by the Court.

The case which was before an Accra Circuit Court, was on May 18, 2020 withdrawn by the Complainant through the Prosecution.

It could be recalled that Ehizogie Binitie and Edwitta Binitie were charged with conspiracy to defraud and defrauding by false pretences.

They however pleaded not guilty when the case was called for hearing.

The couple have each been admitted to bail in the sum of GHC100,000.00 with four sureties each of whom should be gainfully employed.

The Prosecutor, Deputy Superintendent of Police (DSP) George Amega told the Court that Ehiozogie and his wife Edwitta both Directors of Clear Space Company Limited a business development consultancy firm and both reside at Airport Residential Area in March 2017, decided to sell an apartment at the Airport Residential Area to the complainant.

Prosecution said the complainant then made a down payment of $200,000.00 each for each one of the apartments to Ehizogie in the name of Clear Space Company Limited and concluded that the remaining balance on the amounts would be paid after the company had built and reached the lintel levels of the apartment within three months.

The Prosecution said as time went the complainant added $33,000.00 to $400,000.00. but the couple failed to fulfil their part of the agreement and so a report was made to the Criminal Investigations Department and they were arrested.

The Prosecution said Police investigations were later extended to the Registrar General’s Department to authenticate the records of Clear Space Limited which confirmed the core mandate is a business development consultancy firm and not an estate development agency.

Meanwhile, as the case progresses in Court, the Complainant according to the Prosecution had written to withdraw the case against the two Respondents, and thus pleaded with the Court to grant same.

Council for Prosecution, who appeared in Court prayed the Court also stated that, “We will leave that for Court to do so. We do not oppose.

The State brought us here.”

The Court presided over by Her Honour Evelyn Asamoah, granted the Prosecution plea and struck out the case as withdrawn.

“Case struck out as withdrawn by Prosecution. Accused persons are hereby discharged,” the Court ruled.
